J\u00e1 explicamos, <a href=\"https:\/\/voltemosaoevangelho.com\/blog\/2019\/10\/pastor-e-empregado-da-igreja\/\" target=\"_blank\" rel=\"noopener noreferrer\">aqui<\/a>, a natureza confessional e jur\u00eddica da figura da lideran\u00e7a eclesi\u00e1stica. Hoje, vamos tratar de um tema espec\u00edfico, que \u00e9 a previd\u00eancia.<\/p>\n<p>Desde de 1979, pela publica\u00e7\u00e3o da Lei Federal n.6.696, em 8 de outubro, come\u00e7ou-se a findar um hiato legislativo, com a men\u00e7\u00e3o direta ao agora denominado \u201cministro de confiss\u00e3o religiosa\u201d, com seu direito social de previd\u00eancia garantido, embora ainda o colocando como segurado facultativo, para demonstrar o fato de que o sustento eclesi\u00e1stico n\u00e3o caracteriza verba de natureza remunerat\u00f3ria.<\/p>\n<p>Ap\u00f3s a vig\u00eancia da atual Ordem Constitucional, para regulamentar todo o feixe de direitos ali garantidos no que concerne \u00e0 seguridade, foram promulgadas as Leis n.8.212 e n.8.213, de 24 de julho de 1991 \u2013 Lei de Custeio e Lei de Benef\u00edcios, que abrangem, juntamente com a legisla\u00e7\u00e3o afim, o regime geral da previd\u00eancia social no Brasil. Desde ent\u00e3o, o ministro de confiss\u00e3o religiosa est\u00e1 plenamente integrado ao sistema de seguridade social como detentor de direito e, proporcionalmente, devedor do custeio, como segurado obrigat\u00f3rio. Assim, chegamos ao texto ora vigente no Pa\u00eds, o qual reproduzimos aqui:<\/p>\n<blockquote>\n<p style=\"text-align: left;\">Art. 12. S\u00e3o segurados obrigat\u00f3rios da Previd\u00eancia Social as seguintes pessoas f\u00edsicas: [&#8230;] V \u2013 como contribuinte individual: (Reda\u00e7\u00e3o dada pela Lei n. 9.876, de 1999) [&#8230;] c) o ministro de confiss\u00e3o religiosa e o membro de instituto de vida consagrada, de congrega\u00e7\u00e3o ou de ordem religiosa; (Reda\u00e7\u00e3o dada pela Lei n.10.403, de 2002) (grifado).<\/p>\n<\/blockquote>\n<p>As Leis Federais n.8.212 e n.8.213\/91 s\u00e3o as que regem a mat\u00e9ria previdenci\u00e1ria social no Brasil. Quando mantidos pelos institutos, ordens, organiza\u00e7\u00f5es religiosas diretamente ou entidades cong\u00eaneres, a lei diz que s\u00e3o considerados segurados obrigat\u00f3rios do Regime Geral de Previd\u00eancia Social, com a condi\u00e7\u00e3o de contribuintes individuais.<\/p>\n<p>A inscri\u00e7\u00e3o se d\u00e1 mediante declara\u00e7\u00e3o atestando sua condi\u00e7\u00e3o perante a comunidade religiosa que o mantenha. Na condi\u00e7\u00e3o de contribuintes individuais est\u00e1 sujeito, atualmente, a al\u00edquota de contribui\u00e7\u00e3o de 20% (vinte por cento) sobre o sal\u00e1rio de contribui\u00e7\u00e3o mediante guia pr\u00f3pria \u2013 GPS. Como na maioria absoluta dos casos n\u00e3o h\u00e1 a estipula\u00e7\u00e3o certa da remunera\u00e7\u00e3o do religioso, valer\u00e1 a sua declara\u00e7\u00e3o para fins de estabelecimento do sal\u00e1rio de contribui\u00e7\u00e3o, respeitados os limites m\u00ednimo e m\u00e1ximo fixados por lei.[\/vc_column_text][vc_message color=&#8221;alert-danger&#8221; message_box_style=&#8221;outline&#8221; style=&#8221;square&#8221; message_box_color=&#8221;alert-danger&#8221; icon_type=&#8221;pixelicons&#8221; el_class=&#8221;creditos_box&#8221; icon_pixelicons=&#8221;vc_pixel_icon vc_pixel_icon-explanation&#8221;]Por: TR Vieira e Jean Regina. \u00a9 Voltemos ao Evangelho.
